Is the 2nd Amendment under attack? When it appeared that Obama was going to win the election the number of gun sales within our country started to rise. When he was elected along with a strong Democratic majority in both houses the sales skyrocketed. Not only were guns of all kinds being purchased but ammo sales also went through the roof. It is still going on today, 10 months later. During this time frame an important Supreme Court decision was rendered. In Heller vs. Washington D.C. the court voted 5-4 that the 2nd Amendment gave people the right to own and bear arms. While this seemed to be a no-brainer the fact that the court split 5-4 is what should be watched. The Obama administration has done nothing so far to bring new laws limiting our right to buy and have weapons. Or have they? The Supremacy Clause of the Constitution, Article IV, paragraph 2, reads as follows: “This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the Supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the contrary notwithstanding.” We have been led to believe that if indeed a treaty is signed by the US that our laws are superseded. If there is a treaty signed by Obama that limits countries to the types of weapons they may have that it would also mean the US would also be limited. Now I am not a Constitutional scholar but I believe that our Constitution trumps any treaty and if we have the Freedom of Speech and the Freedom to own and bear arms that we will continue to have it. There are many who would disagree with me on this and say a treaty does supersede our Constitution. No Supreme Court decision on this one yet. On the other hand in California we are under attack by a gent named Deleon from LA. Along with his fellow Democrats he has been the pushing force behind the restrictions put on the law abiding citizens of California from having the same rights that other Americans have in the purchase and ownership of weapons. And the latest attack on our rights is AB 962 which has me give a thumbprint every time I buy any handgun ammo including the well know gang ammo of .22 caliber. Now I don’t want to rant here but why is it I can walk into one of the many stores now in Redding and buy marijuana, a federally outlawed drug for which we spend billions to eradicate, and do not have to give a thumbprint nor do I have to worry that the California legislature is going to do anything to limit the amount of medicinal marijuana I may need to bring myself to health.
The chipping away of our rights is the danger here. The continued pursuit of our right to have a weapon should not be tolerated because I promise you that once one right is extinguished there will be others to follow.
